Indiana Abortion Clinics Sue to Block Ban Set to Take Effect

Indiana’s abortion clinics are fighting back against a new law that would ban the procedure, arguing that it violates their constitutional rights.

The law, which is set to take effect in July, would make it illegal for doctors to perform abortions in Indiana. The American Civil Liberties Union of Indiana filed a lawsuit on behalf of two clinics on Tuesday, arguing that the law is unconstitutional.

“This law is a dangerous and unconstitutional attack on Indiana women,” said ACLU of Indiana Legal Director Ken Falk. “It blatantly violates the U.S. Constitution by infringing on a woman’s right to make her own reproductive choices.”

The lawsuit challenges the constitutionality of the law on several grounds, including that it violates the due process and equal protection clause Indiana Constitution. It also argues that the law would unconstitutionally restrict abortion access in Indiana.

“If this law takes effect, it will have a devastating impact on Indiana women and their families,” said Caitlin Breedlove, co-director of Southerners On New Ground (SONG), one of the groups that filed the lawsuit. “

”We are fighting back to ensure that all Indiana women can make their own decisions about their bodies and their futures.”

The lawsuit is just the latest battle in the ongoing fight over abortion access in Indiana. In 2016, the state passed a law that would have required abortion providers to bury or cremate fetal remains.

That law was later blocked by a federal judge. And last year, Indiana became the first state in the country to ban abortions based on genetic abnormalities.

Fight Over Abortions Right Is Not Over

Indiana’s abortion clinics are not alone in their legal challenges to restrictive abortion laws. Clinics across the country have been fighting similar battles, and earlier this month, the U.S. Supreme Court struck down a Louisiana law that would have placed burdensome restrictions on abortion providers.

With anti-abortion lawmakers in Indiana and other states vowing to continue their fight, it’s clear that the legal battle over abortion access is far from over.
